⑴ 缺陷汽車產品召回管理規定的具體規章

第一條為加強對缺陷汽車產品召回事項的管理,消除缺陷汽車產品對使用者及公眾人身、財產安全造成的危險,維護公共安全、公眾利益和社會經濟秩序,根據《中華人民共和國產品質量法》等法律制定本規定。
第二條凡在中華人民共和國境內從事汽車產品生產、進口、銷售、租賃、修理活動的,適用本規定。
第三條汽車產品的製造商(進口商)對其生產(進口)的缺陷汽車產品依本規定履行召回義務,並承擔消除缺陷的費用和必要的運輸費;汽車產品的銷售商、租賃商、修理商應當協助製造商履行召回義務。
第四條售出的汽車產品存在本規定所稱缺陷時,製造商應按照本規定中主動召回或指令召回程序的要求,組織實施缺陷汽車產品的召回。
國家根據經濟發展需要和汽車產業管理要求,按照汽車產品種類分步驟實施缺陷汽車產品召回制度。
國家鼓勵汽車產品製造商參照本辦法規定,對缺陷以外的其他汽車產品質量等問題,開展召回活動。
第五條本規定所稱汽車產品,指按照國家標准規定,用於載運人員、貨物,由動力驅動或者被牽引的道路車輛。
本規定所稱缺陷,是指由於設計、製造等方面的原因而在某一批次、型號或類別的汽車產品中普遍存在的具有同一性的危及人身、財產安全的不合理危險,或者不符合有關汽車安全的國家標準的情形。
本規定所稱製造商,指在中國境內注冊,製造、組裝汽車產品並以其名義頒發產品合格證的企業,以及將製造、組裝的汽車產品已經銷售到中國境內的外國企業。
本規定所稱進口商,指從境外進口汽車產品到中國境內的企業。進口商視同為汽車產品製造商。
本規定所稱銷售商,指銷售汽車產品,並收取貨款、開具發票的企業。
本規定所稱租賃商,指提供汽車產品為他人使用,收取租金的自然人、法人或其他組織。
本規定所稱修理商,指為汽車產品提供維護、修理服務的企業和個人。
本規定所稱製造商、進口商、銷售商、租賃商、修理商,統稱經營者。
本規定所稱車主,是指不以轉售為目的,依法享有汽車產品所有權或者使用權的自然人、法人或其他組織。
本規定所稱召回,指按照本規定要求的程序,由缺陷汽車產品製造商(包括進口商,下同)選擇修理、更換、收回等方式消除其產品可能引起人身傷害、財產損失的缺陷的過程。 第六條國家質量監督檢驗檢疫總局(以下稱主管部門)負責全國缺陷汽車召回的組織和管理工作。
國家發展改革委員會、商務部、海關總署等國務院有關部門在各自職責范圍內,配合主管部門開展缺陷汽車召回的有關管理工作。
各省、自治區、直轄市質量技術監督部門和各直屬檢驗檢疫機構(以上稱地方管理機構)負責組織本行政區域內缺陷汽車召回的監督工作。
第七條缺陷汽車產品召回的期限,整車為自交付第一個車主起,至汽車製造商明示的安全使用期止;汽車製造商未明示安全使用期的,或明示的安全使用期不滿10年的,自銷售商將汽車產品交付第一個車主之日起10年止。
汽車產品安全性零部件中的易損件,明示的使用期限為其召回時限;汽車輪胎的召回期限為自交付第一個車主之日起3年止。
第八條判斷汽車產品的缺陷包括以下原則:
(一)經檢驗機構檢驗安全性能存在不符合有關汽車安全的技術法規和國家標準的;
(二)因設計、製造上的缺陷已給車主或他人造成人身、財產損害的;
(三)雖未造成車主或他人人身、財產損害,但經檢測、實驗和論證,在特定條件下缺陷仍可能引發人身或財產損害的。
第九條缺陷汽車產品召回按照製造商主動召回和主管部門指令召回兩種程序的規定進行。
製造商自行發現,或者通過企業內部的信息系統,或者通過銷售商、修理商和車主等相關各方關於其汽車產品缺陷的報告和投訴,或者通過主管部門的有關通知等方式獲知缺陷存在,可以將召回計劃在主管部門備案後,按照本規定中主動召回程序的規定,實施缺陷汽車產品召回。
製造商獲知缺陷存在而未採取主動召回行動的,或者製造商故意隱瞞產品缺陷的,或者以不當方式處理產品缺陷的,主管部門應當要求製造商按照指令召回程序的規定進行缺陷汽車產品召回。
第十條主管部門會同國務院有關部門組織建立缺陷汽車產品信息系統,負責收集、分析與處理有關缺陷的信息。經營者應當向主管部門及其設立的信息系統報告與汽車產品缺陷有關的信息。
第十一條主管部門應當聘請專家組成專家委員會,並由專家委員會實施對汽車產品缺陷的調查和認定。根據專家委員會的建議,主管部門可以委託國家認可的汽車產品質量檢驗機構,實施有關汽車產品缺陷的技術檢測。專家委員會對主管部門負責。
第十二條主管部門應當對製造商進行的召回過程加以監督,並根據工作需要部署地方管理機構進行有關召回的監督工作。
第十三條製造商或者主管部門對已經確認的汽車產品存在缺陷的信息及實施召回的有關信息,應當在主管部門指定的媒體上向社會公布。
第十四條缺陷汽車產品信息系統和指定的媒體發布缺陷汽車產品召回信息,應當客觀、公正、完整。
第十五條從事缺陷汽車召回管理的主管部門及地方機構和專家委員會、檢驗機構及其工作人員,在調查、認定、檢驗等過程中應當遵守公正、客觀、公平、合法的原則,保守相關企業的技術秘密及相關缺陷調查、檢驗的秘密;未經主管部門同意,不得擅自泄露相關信息。 第十六條製造商應按照國家標准《道路車輛識別代號》(GB/T16735—16738)中的規定,在每輛出廠車輛上標注永久性車輛識別代碼(VIN);應當建立、保存車輛及車主信息的有關記錄檔案。對上述資料應當隨時在主管部門指定的機構備案(見附件1)。
製造商應當建立收集產品質量問題、分析產品缺陷的管理制度,保存有關記錄。
製造商應當建立汽車產品技術服務信息通報制度,載明有關車輛故障排除方法,車輛維護、維修方法,服務於車主、銷售商、租賃商、修理商。通報內容應當向主管部門指定機構備案。
製造商應當配合主管部門對其產品可能存在的缺陷進行的調查,提供調查所需的有關資料,協助進行必要的技術檢測。
製造商應當向主管部門報告其汽車產品存在的缺陷;不得以不當方式處理其汽車產品缺陷。
製造商應當向車主、銷售商、租賃商提供本規定附件3和附件4規定的文件,便於其發現汽車產品存在缺陷後提出報告。
第十七條銷售商、租賃商、修理商應當向製造商和主管部門報告所發現的汽車產品可能存在的缺陷的相關信息,配合主管部門進行的相關調查,提供調查需要的有關資料,並配合製造商進行缺陷汽車產品的召回。
第十八條車主有權向主管部門、有關經營者投訴或反映汽車產品存在的缺陷,並可向主管部門提出開展缺陷產品召回的相關調查的建議。
車主應當積極配合製造商進行缺陷汽車產品召回。
第十九條任何單位和個人,均有權向主管部門和地方管理機構報告汽車產品可能存在的缺陷。
主管部門針對汽車產品可能存在的缺陷進行調查時,有關單位和個人應當予以配合。 第二十條製造商確認其汽車產品存在缺陷,應當在5個工作日內以書面形式向主管部門報告(書面報告格式見附件2);製造商在提交上述報告的同時,應當在10個工作日內以有效方式通知銷售商停止銷售所涉及的缺陷汽車產品,並將報告內容通告銷售商。境外製造商還應在10個工作日內以有效方式通知進口商停止進口缺陷汽車產品,並將報告內容報送商務部並通告進口商。
銷售商、租賃商、修理商發現其經營的汽車產品可能存在缺陷,或者接到車主提出的汽車產品可能存在缺陷的投訴,應當及時向製造商和主管部門報告(書面報告格式見附件3)。
車主發現汽車產品可能存在缺陷,可通過有效方式向銷售商或主管部門投訴或報告(書面報告格式見附件4)。
其他單位和個人發現汽車產品可能存在缺陷應參照上述附件中的內容和格式向主管部門報告。
第二十一條主管部門接到製造商關於汽車產品存在缺陷並符合附件2的報告後,按照第五章缺陷汽車產品主動召回程序處理。
第二十二條主管部門根據其指定的信息系統提供的分析、處理報告及其建議,認為必要時,可將相關缺陷的信息以書面形式通知製造商,並要求製造商在指定的時間內確認其產品是否存在缺陷及是否需要進行召回。
第二十三條製造商在接到主管部門依第二十二條規定發出的通知,並確認汽車產品存在缺陷後,應當在5個工作日內依附件2的書面報告格式向主管部門提交報告,並按照第五章缺陷汽車產品主動召回程序實施召回。
製造商能夠證明其產品不需召回的,應向主管部門提供詳實的論證報告,主管部門應當繼續跟蹤調查。
第二十四條製造商在第二十三條所稱論證報告中不能提供充分的證明材料或其提供的證明材料不足以證明其汽車產品不存在缺陷,又不主動實施召回的,主管部門應當組織專家委員會進行調查和鑒定,製造商可以派代表說明情況;
主管部門認為必要時,可委託國家認可的汽車質量檢驗機構對相關汽車產品進行檢驗。
主管部門根據專家委員會意見和檢測結果確認其產品存在缺陷的,應當書面通知製造商實施主動召回,有關缺陷鑒定、檢驗等費用由製造商承擔。如製造商仍拒絕主動召回,主管部門應責令製造商按照第六章的規定實施指令召回程序。 第二十五條製造商確認其生產且已售出的汽車產品存在缺陷決定實施主動召回的,應當在按本規定第二十條或者第二十三條的要求向主管部門報告,並應當及時制定包括以下基本內容的召回計劃,提交主管部門備案:
(一)有效停止缺陷汽車產品繼續生產的措施;
(二)有效通知銷售商停止批發和零售缺陷汽車產品的措施;
(三)有效通知相關車主有關缺陷的具體內容和處理缺陷的時間、地點和方法等;
(四)客觀公正地預測召回效果。
境外製造商還應提交有效通知進口商停止缺陷汽車產品進口的措施。
第二十六條製造商在向主管部門備案同時,應當立即將其汽車產品存在的缺陷、可能造成的損害及其預防措施、召回計劃等,以有效方式通知有關進口商、銷售商、租賃商、修理商和車主,並通知銷售商停止銷售有關汽車產品,進口商停止進口有關汽車產品。製造商須設置熱線電話,解答各方詢問,並在主管部門指定的網站上公布缺陷情況供公眾查詢。
第二十七條製造商依第二十五條的規定提交附件2的報告之日起1個月內,制定召回通知書(見附件5),向主管部門備案,同時告知銷售商、租賃商、修理商和車主,並開始實施召回計劃。
第二十八條製造商按計劃完成缺陷汽車產品召回後,應在1個月內向主管部門提交召回總結報告(見附件9)。
第二十九條主管部門應當對製造商採取的主動召回行動進行監督,對召回效果進行評估,並提出處理意見。
主管部門認為製造商所進行的召回未能取得預期效果,可通知製造商再次進行召回,或依法採取其他補救措施。 第三十條主管部門依第二十四條規定經調查、檢驗、鑒定確認汽車產品存在缺陷,而製造商又拒不召回的,應當及時向製造商發出指令召回通知書(見附件6)。國家認證認可監督管理部門責令認證機構暫停或收回汽車產品強制性認證證書。對境外生產的汽車產品,主管部門會同商務部和海關總署發布對缺陷汽車產品暫停進口的公告,海關停止辦理缺陷汽車產品的進口報關手續。在缺陷汽車產品暫停進口公告發布前,已經運往我國尚在途中的,或業已到達我國尚未辦結海關手續的缺陷汽車產品,應由進口商按海關有關規定辦理退運手續。
主管部門根據缺陷的嚴重程度和消除缺陷的緊急程度,決定是否需要立即通報公眾有關汽車產品存在的缺陷和避免發生損害的緊急處理方法及其他相關信息。
第三十一條製造商應當在接到主管部門指令召回的通知書之日起5個工作日內,通知銷售商停止銷售該缺陷汽車產品,在10個工作日內向銷售商、車主發出關於主管部門通知該汽車存在缺陷的信息。境外製造商還應在5個工作日內通知進口商停止進口該缺陷汽車產品。
製造商對主管部門的決定等具體行政行為有異議的,可依法申請行政復議或提起行政訴訟。在行政復議和行政訴訟期間,主管部門通知中關於製造商進行召回的內容暫不實施,但製造商仍須履行前款規定的義務。
第三十二條製造商接到主管部門關於缺陷汽車產品指令召回通知書之日起10個工作日內,應當向主管部門提交符合本規定第二十五條要求的有關文件。
第三十三條主管部門應當在收到該缺陷汽車產品召回計劃後5個工作日內將審查結果通知製造商。
主管部門批准召回計劃的,製造商應當在接到批准通知之日起1個月內,依據批準的召回計劃制定缺陷汽車產品召回通知書(見附件5),向銷售商、租賃商、修理商和車主發出該召回通知書,並報主管部門備案。召回通知書應當在主管部門指定的報刊上連續刊登3期,召回期間在主管部門指定網站上持續發布。
主管部門未批准召回計劃的,製造商應按主管部門提出的意見進行修改,並在接到通知之日起10個工作日內再次向主管部門遞交修改後的召回計劃,直至主管部門批准為止。
第三十四條製造商應在發出召回通知書之日起,開始實施召回,並在召回計劃時限內完成。
製造商有合理原因未能在此期限內完成召回的,應向主管部門提出延長期限的申請,主管部門可根據製造商申請適當延長召回期限。
第三十五條製造商應自發出召回通知書之日起,每3個月向主管部門提交符合本規定要求(見附件7)的召回階段性進展情況的報告;主管部門可根據召回的實際效果,決定製造商是否應採取更為有效的召回措施。
第三十六條對每一輛完成召回的缺陷汽車,製造商應保存符合本規定要求(見附件8)的召回記錄單。召回記錄單一式兩份,一份交車主保存,一份由製造商保存。
第三十七條製造商按計劃完成召回後,應在1個月內向主管部門提交召回總結報告(見附件9)。
第三十八條主管部門應對製造商提交的召回總結報告進行審查,並在15個工作日內書面通知製造商審查結論。審查結論應向社會公布。
主管部門認為製造商所進行的召回未能取得預期的效果,可責令製造商採取補救措施,再次進行召回。
如製造商對審查結論有異議,可依法申請行政復議或提起行政訴訟。在行政復議或行政訴訟期間,主管部門的決定暫不執行。
第三十九條主管部門應及時公布製造商在中國境內進行的缺陷汽車召回、召回效果審查結論等有關信息,通過指定網站公布,為查詢者提供有關資料。
主管部門應向商務部和海關總署通報進口缺陷汽車的召回情況。 第四十條製造商違反本規定第十六條第一、二、三、四款規定,不承擔相應義務的,質量監督檢驗檢疫部門應當責令其改正,並予以警告。
第四十一條銷售商、租賃商、修理商違反本規定第十七條有關規定,不承擔相應義務的,質量監督檢驗檢疫部門可以酌情處以警告、責令改正等處罰;情節嚴重的,處以1,000元以上5,000元以下罰款。
第四十二條有下列情形之一的,主管部門可責令製造商重新召回,通報批評,並由質量監督檢驗檢疫部門處以10,000元以上30,000元以下罰款:
(一)製造商故意隱瞞缺陷的嚴重性的;
(二)試圖利用本規定的缺陷汽車產品主動召回程序,規避主管部門監督的;
(三)由於製造商的過錯致使召回缺陷產品未達到預期目的,造成損害再度發生的。
第四十三條從事缺陷汽車管理職能的管理機構及其工作人員,受其委託進行缺陷調查、檢驗和認定的工作人員,徇私舞弊,違反保密規定的,給予行政處分;直接責任人徇私舞弊,貪贓枉法,構成犯罪的,依法追究刑事責任。
有關專家作偽證,檢驗人員出具虛假檢驗報告,或捏造散布虛假信息的,取消其相應資格,造成損害的,承擔賠償責任;構成犯罪的,依法追究刑事責任。 第四十四條製造商實施缺陷汽車產品召回,不免除車主及其他受害人因缺陷汽車產品所受損害,要求其承擔的其他法律責任
第四十五條本規定由國家質量監督檢驗檢疫總局、國家發展和改革委員會、商務部、海關總署在各自職責范圍內負責解釋。
第四十六條本規定自2004年10月1日起實施。
* 自2006年8 月1日起對M2、M3類車輛(駕駛員座位在內座位數超過9個的載客車輛)也開始適用《缺陷汽車產品召回管理規定》。

經國家質量監督檢驗檢疫總局局務會議審議,並經國家發展和改革委員會、商務部、海關總署同意,決定廢止《缺陷汽車產品召回管理規定》(國家質量監督檢驗檢疫總局、國家發展和改革委員會、商務部、海關總署令第60號,2004年3月12日發布),本決定自2016年1月1日起生效。

《缺陷產品召回管理條例》目前沒有出台,但是我國目前有《缺陷汽車產品召版回管理條例》在權實施。
《缺陷汽車產品召回管理條例》已經2012年10月10日國務院第219次常務會議通過,現予公布,自2013年1月1日起施行。
為了規范缺陷汽車產品召回,加強監督管理,保障人身、財產安全,制定本條例。在中國境內生產、銷售的汽車和汽車掛車(以下統稱汽車產品)的召回及其監督管理,適用本條例。

⑷ 缺陷產品召回制度

缺陷產品召回制度是指在產品存在缺陷有危害消費者安全與健康的危險場合,如果經營者自行或經他人通知發現這一情況,經營者(包括產品的製造者)應主動將此具有危險的商品回收,以免使消費者實際權益遭受實際損害;如果經營者發現該危險,但卻不加以處理,此時,為保護消費者權益,並維護消費者人身或財產安全,相關主管機關可強制經營者回收商品的制度。此制度對於保護消費者的人身安全具有重要的意義,體現了現代法治「以人為本」的精神。其具有:
第一,預防性。缺陷產品的召回並不需要以產品已經產生實際損害為前提,只要生產者者發現其生產的產品存在或者可能存在危及消費者的人身安全和生命健康的危險時,即應當主動召回其已投入市場的缺陷產品。傳統的民事權利救濟方式主要為違約責任救濟和侵權責任救濟,這兩種救濟方式的應用通常建立在已經確定的損害後果上,當事人主張救濟時,損害通常已經現實的發生,與此不同的是產品召回並不以損害為前提,只要存在危及人身安全和生命健康的危險時,生產者就有義務召回其生產的產品。因此,預防性是缺陷產品召回制度的一項主要特徵之一。
第二,公益性。缺陷產品召回制度起源於美國的汽車業,從這項制度起源之時起,就賦予其維護社會公共利益的使命。二十世紀六十年代的美國,每年都有數萬人死於交通事故,一百多萬人受傷,缺陷汽車對消費者的人身安全和生命健康產生巨大的危害,1966年,美國出台了《國家交通與機動車安全法》,從而奠定了產品召回制度的法律基礎,隨後美國汽車業開始實施召回制度並取得良好的社會經濟效果。缺陷產品召回制度有利於保護消費者的合法權益,維護社會經濟秩序,促進市場公平競爭,同時也有助於企業改善其商業信譽和商品聲譽。缺陷產品召回制度著眼於整個社會的公共利益和長遠利益,從整體上約束企業的行為,體現了經濟法以社會整體利益為為本的思想。生產者召回缺陷產品,有利於保護社會不特定公眾的利益,維護社會安全。
第三,主動性。缺陷產品召回主要依靠企業自主召回,是缺陷產品召回的常態。只有在企業的產品存在嚴重危及消費者人身、財產安全的缺陷企業仍不主動召回時,才由主管機關責令召回,而這是缺陷產品召回的非常態措施。並且現代科技的發展,使產品缺陷的發現變得越來越困難,如果要消費者和政府主管機關從外部來發現企業產品的缺陷,未免困難,效果也不好,只有生產者對其產品的性能、質量狀況最了解,也最容易發現其產品的缺陷,因此,主要由企業主動負責其缺陷產品的召回具有實體正當的合理性也具有程序上的方便性。
第四,綜合性。一是指公法與私法因素的綜合。「從召回制度適用的法律關系、保護的對象、啟動的方式等方面來看,該制度兼具私法與公法的雙重特性」 ,產品召回制度反映了私法公法化得趨勢,國家公權力為了維護社會公共利益而介入私法關系的范疇,在生產者不主動召回其生產的缺陷產品時,國家產品質量監督管理部門可以責令企業召回其產品。產品召回制度作為一種現代新興的法律制度,其具有新興法律所普遍具有的私法公法化、公法私法化得趨勢。
