『貳』 開庭後休庭是什麼意思
休庭是法庭審理程序的暫停，以便庭審人員休息或進行合議或出現其他情況時適用的一個程序。
在審判長宣布休庭時，如果說「擇日審理」就有可能還要開庭，會告知告當事人復庭的時間；如果說「擇日宣判」就不開庭審理，下次去法庭只是領取判決書。有時審判長只說「休庭」，那下次是開庭審理還是宣判就不一定的。
《刑事訴訟法》第一百九十一條：法庭審理過程中，合議庭對證據有疑問的，可以宣布休庭，對證據進行調查核實。人民法院調查核實證據，可以進行勘驗、檢查、查封、扣押、鑒定和查詢、凍結。

按照普遍的理解，休庭，是法庭審理程序的暫停，以便庭審人員休息或進行合議或出現其他情況時適用。閉庭，一般是庭審程序的結束。
法律沒有規定如何區別適用休庭、閉庭，休庭和閉庭被混淆適用，主要還是對閉庭的適用理解不同。審判人員對於閉庭的理解有所不同，有的理解為每次庭審結束即為閉庭，指的是單次的庭審結束。
有的理解為閉庭是對該案所有庭審程序的完結，直接進入到宣判環節。而這兩種理解的不同也就造成了不同的後果：前者在符合法定條件的情況下，可以再次開庭審理，對案件事實及法律適用進行質證辯論；後者則意味著案件所有的庭審程序已經結束，不區分庭審次數，一旦宣布閉庭，就表示案件所有的庭審程序都完結了。
當然，也有的審判人員認為在單次庭審結束後，應該適用休庭，案件宣判或調解結案前每次庭審結束時應稱作休庭，這樣能保證案件從受理到宣判是一個完整的體系。
休庭是指庭審程序的暫停並不是終止，是對上次暫停庭審的延續，如果案件在結案前每次庭審結束時均稱作休庭，那麼案件的審理必然應該有一次閉庭庭審。
也就是說，一件案件的審理，單次庭審結束後適用休庭的話，那麼無論開幾次庭審，必然要加上一次閉庭的庭審，才能保證案件審理的完整性，否則，案件的庭審只停留在暫停階段，沒有完結。
在已經審結的案件中，如果審判人員庭審結束時適用的是休庭，沒有進行閉庭的庭審就直接宣判，程序上就產生了瑕疵。在正常庭審後休庭，沒有實質庭審的必要而形式上再進行一次閉庭庭審毫無意義，且對於基層法院審判來說無疑是增加了審判壓力，影響了案件的審判效率。

這個話不一定必須要由法官說，也可以由其助理說出來，並且聯邦回和州的法官說的答有些不同，以聯邦地區法院為例吧。
