『贰』 开庭后休庭是什么意思
休庭是法庭审理程序的暂停，以便庭审人员休息或进行合议或出现其他情况时适用的一个程序。
在审判长宣布休庭时，如果说“择日审理”就有可能还要开庭，会告知告当事人复庭的时间；如果说“择日宣判”就不开庭审理，下次去法庭只是领取判决书。有时审判长只说“休庭”，那下次是开庭审理还是宣判就不一定的。
《刑事诉讼法》第一百九十一条：法庭审理过程中，合议庭对证据有疑问的，可以宣布休庭，对证据进行调查核实。人民法院调查核实证据，可以进行勘验、检查、查封、扣押、鉴定和查询、冻结。

按照普遍的理解，休庭，是法庭审理程序的暂停，以便庭审人员休息或进行合议或出现其他情况时适用。闭庭，一般是庭审程序的结束。
法律没有规定如何区别适用休庭、闭庭，休庭和闭庭被混淆适用，主要还是对闭庭的适用理解不同。审判人员对于闭庭的理解有所不同，有的理解为每次庭审结束即为闭庭，指的是单次的庭审结束。
有的理解为闭庭是对该案所有庭审程序的完结，直接进入到宣判环节。而这两种理解的不同也就造成了不同的后果：前者在符合法定条件的情况下，可以再次开庭审理，对案件事实及法律适用进行质证辩论；后者则意味着案件所有的庭审程序已经结束，不区分庭审次数，一旦宣布闭庭，就表示案件所有的庭审程序都完结了。
当然，也有的审判人员认为在单次庭审结束后，应该适用休庭，案件宣判或调解结案前每次庭审结束时应称作休庭，这样能保证案件从受理到宣判是一个完整的体系。
休庭是指庭审程序的暂停并不是终止，是对上次暂停庭审的延续，如果案件在结案前每次庭审结束时均称作休庭，那么案件的审理必然应该有一次闭庭庭审。
也就是说，一件案件的审理，单次庭审结束后适用休庭的话，那么无论开几次庭审，必然要加上一次闭庭的庭审，才能保证案件审理的完整性，否则，案件的庭审只停留在暂停阶段，没有完结。
在已经审结的案件中，如果审判人员庭审结束时适用的是休庭，没有进行闭庭的庭审就直接宣判，程序上就产生了瑕疵。在正常庭审后休庭，没有实质庭审的必要而形式上再进行一次闭庭庭审毫无意义，且对于基层法院审判来说无疑是增加了审判压力，影响了案件的审判效率。
